What a valid DMCA notice must contain
Under 17 U.S.C. § 512(c)(3), a notification of claimed infringement must include all six of the following elements. A notice missing any of them may not be actionable:
- A physical or electronic signature of the copyright owner or a person authorised to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed — or, if multiple works at one site are covered, a representative list of them.
- Identification of the infringing material and information reasonably sufficient to locate it (for example, the exact URL of the offending page).
- Contact information for the complaining party: address, telephone number and, if available, an email address.
- A statement that the complaining party has a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and — under penalty of perjury — that the complaining party is authorised to act on behalf of the copyright owner.
Counter-notification
If material of yours was removed in response to a notice and you believe that was a mistake or misidentification, you may send a counter-notification containing your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake, and your name, address, telephone number and consent to the jurisdiction of the federal court for your district.
Repeat infringers
We will pursue repeat infringement through the relevant host, registrar and search engine removal processes, and through the courts of Harris County, Texas where necessary.
